1. General/Applicability
These General Terms and Conditions apply to all deliveries and services provided by rxgames .
2. Offer
All offers from rxgames on the website www.rxgames.de are non-binding and subject to change. Slight deviations and technical changes from our illustrations or descriptions are possible. The contract is concluded by completing the ordering process on the website of rxgames and confirming the order by rxgames by e-mail or by executing the order by rxgames .
3. Prices and Payment Terms
The prices shown on the website of rxgames at the time of ordering apply. All prices quoted are final prices in euros and include the statutory value-added tax of currently 19 percent. Obvious price errors are reserved. Packaging and shipping costs will be charged additionally. rxgames accepts all payment methods offered on the website of rxgames during the ordering process. The customer chooses his preferred payment method himself. Costs (e.g. cash on delivery fee) that may arise from the payment method are also charged additionally. Offset of mutual claims is only possible with the express written consent of rxgames .
4. Delivery, Delivery Times and Shipping Costs
The delivery of the goods to the customer is carried out by third-party providers (delivery services) specified within the order process. The customer chooses their preferred shipping method. The shipping costs will be made known to the customer before triggering the order process within the shopping cart. Goods in stock will be shipped within three working days of receipt of the order. For goods not in stock, the delivery time may take up to four weeks after receipt of the order. The delivery possibility depends on timely self-supply by rxgames. If delivery fails for reasons that rxgames is not responsible for, rxgames can withdraw from the contract. rxgames undertakes to inform the customer in a timely manner. Any payments made will be refunded immediately. In this case, the customer has no right to claim damages. Partial deliveries are permissible as long as the customer has no apparent lack of interest in them or they are not evidently unreasonable. In this case, the costs for transport and packaging will be charged only once.
5. Right of withdrawal

You have the right to withdraw from this contract within fourteen days without giving any reason. The withdrawal period will expire after fourteen days from the day on which you acquire, or a third party other than the carrier and indicated by you acquires, physical possession of the goods. of your decision to withdraw from this contract by an unequivocal statement (e.g. a letter sent by post, fax or e-mail). You may use the attached model withdrawal form, but it is not obligatory. To meet the withdrawal deadline, it is sufficient for you to send your communication concerning your exercise of the right of withdrawal before the withdrawal period has expired.
Consequences of Withdrawal
If you withdraw from this contract, we shall reimburse to you all payments received from you, including the costs of delivery (with the exception of the supplementary costs resulting from your choice of a type of delivery other than the least expensive type of standard delivery offered by us), without undue delay and in any event not later than fourteen days from the day on which we are informed about your decision to withdraw from this contract. We will carry out such reimbursement using the same means of payment as you used for the initial transaction, unless you have expressly agreed otherwise; in any event, you will not incur any fees as a result of such reimbursement.
We may withhold reimbursement until we have received the goods back or you have supplied evidence of having sent back the goods, whichever is the earliest.
You shall send back the goods or hand them over to us, without undue delay and in any event not later than fourteen days from the day on which you communicate your withdrawal from this contract to us. The deadline is met if you send back the goods before the period of fourteen days has expired. You will bear the direct cost of returning the goods. You are only liable for any diminished value of the goods resulting from the handling other than what is necessary to establish the nature, characteristics and functioning of the goods.

6. Warranty
rxgames guarantees that the goods sold at the time of the transfer of risk are free from material and manufacturing defects and have the contractually agreed properties. The statutory warranty period of two years from receipt of the goods applies. The warranty does not cover normal wear and tear. rxgames shall be liable in case of intentional or grossly negligent breach of contract or if the guaranteed properties are lacking. Claims under the Product Liability Act remain unaffected. If defects occur for which rxgames is responsible, and in the event that the replacement delivery is also defective in the case of an exchange of goods, the buyer shall have the right to rescission or reduction. rxgames shall not be liable for the constant and uninterrupted availability of www.rxgames.de or for technical or electronic errors in the online offer.
7. Retention of title
All deliveries are made subject to retention of title. The delivered goods remain the property of rxgames until full payment of the purchase price has been made.
8. Data Storage/Data Protection
In accordance with §28 BDSG (Federal Data Protection Act), we would like to inform you that the data necessary for the processing of the transaction will be processed and stored by means of an electronic data processing system in accordance with § 33 BDSG. All personal data collected from the customer will be treated confidentially. The necessary data will only be disclosed to third parties within the scope of order processing (payment, shipping). You can obtain information about the data stored about you free of charge at any time. To do so, please send an email via our contact form. For data protection reasons, the response to the email can only be sent to the email address registered with rxgames.
9. Jurisdiction Agreement
The exclusive place of jurisdiction is the local court of our place of business if the customer is a merchant within the meaning of the German Commercial Code or a public corporation.
10. Final Provision
If the above provisions have not become or have become partly invalid as part of the contract, the contract remains otherwise effective. If the provisions are not part of the contract or are invalid, the content of the contract shall be governed by the statutory provisions.
The contractual relationship between us and the customer as well as the respective terms and conditions are subject to the law of the Federal Republic of Germany. If the customer is a consumer, the applicable legal regulations and rights under the law of the country of residence of the customer that are in favor of the consumer shall remain unaffected by this agreement. The application of the UN Sales Convention is excluded.
11. Packaging Ordinance
We are obliged under the provisions of the Packaging Ordinance to take back packaging of our products that do not bear the mark of a comprehensive disposal system (such as the "Green Dot" of the Dual System Deutschland AG or the "RESY" symbol) and to ensure its reuse or disposal. We will then name a municipal collection point or a disposal company in your area that will accept the packaging free of charge. If this is not possible, you have the option of sending the packaging back to us. We will reuse the packaging or dispose of it in accordance with the provisions of the Packaging Ordinance.
12. Battery Ordinance
In connection with the distribution of battery- and accumulator-operated devices, we as a retailer are obliged under the Battery Ordinance to inform customers as consumers of the following: The customer is legally obliged to dispose of batteries and accumulators properly. The customer can return them free of charge to a municipal collection point or to a local retailer after use. Batteries purchased from rxgames can also be returned to us:

Batteries containing pollutants are marked with a symbol consisting of a crossed-out waste bin and the chemical symbol (Cd, Hg or Pb) of the heavy metal that is decisive for the classification as pollutant.
